Section 3
<br> who can form the board
The Government of Nepal may, by publishing a notice in the Nepal Gazette, establish a drinking water management board as necessary in consultation with the relevant municipality to effectively operate and manage the service system and services of one or more municipal areas operated by any government agency or institution at the time this Act commences. .
(2) If the service system and services as per sub-section (1) are being operated in some or the whole part of the rural municipality, such part of the rural municipality may also be included in the geographical area of the board formed as per sub-section (1).
(3) Notwithstanding anything written in sub-section (1), if a municipality wishes to have any service system or service operated by a government agency, municipality or corporation operated and managed in accordance with this Act, it may submit an application to the Government of Nepal to establish a board by providing the following details:-< br> (a) Geographical area where the service will be operated and managed (b) If the service has been extended to any rural municipality attached to the municipality, details of the same (c) the status of water resources within or related to the area where the service will be operated and managed,
(d) Estimated number of consumers and details of service demand,
(e) the estimated cost of operating the Service,
(f) long-term plan prepared for service operation, management, maintenance and improvement or service expansion,
(g) An action plan prepared to make the service efficient and quality,
(h) The Board itself conducts the service or conducts the service through another person or organization,
(i) If the service system operated by any government body is transferred to the board and the service is operated, the assets and liabilities associated with such service system and the method of transfer thereof and other related provisions, and
(J) Other things as specified.
(4) If it is found necessary to form such a board while examining the application made under sub-section (3), the Government of Nepal may publish a notice in the Nepal Gazette and form a board according to the request of the petitioner.
